What OSHA requirements are you referencing? I know of no OSHA regulations governing the distance a smoker must stand from a door. This is generally governed by state legislation, and in some areas, local legislation can be stricter than the state legislation. For example, in most of Texas, a smoker is required to stand at least 25 feet from a door. In Illinois, a smoker must stand 15 feet away from any door, window or air vent. In other states, such as South Carolina, there is no set distance. An employee can smoke 1 inch outside the door. What is the legislative requirement in your state?

As far as washing hands, did the employee handle your food or was he just your cashier? Health department regulations require that a food handler wash hands after using the bathroom or exiting and re-entering the food preparation area. A cashier is required to wash hands after using the bathroom but there is not, in the legislation of most states, a requirement for a cashier to wash hands after smoking a cigarette.

If you were overcharged, I would definitely report it.

I agree that when employees break the state smoking and health laws, it should be reported, but understand that there is not one law that applies in all states.

Why wouldn't you put the smoking distance in your report? I wouldn't report it to the scheduler.

My objective is to report what I see and to answer the questions on the survey/report accurately. If there is a question about employees smoking and where did you see them, it goes in to the report. The scheduler sees the report before the client. If it is not in the report she is not going to add it, just because you email her about it.

As for the hand washing, on well. There should be a law about washing your handsgrinning smiley
OSHA has nothing to do with that smoking near the door thing. That's a state and local issue, precisely becasue OSHA has not acted on it.

I have often wondered...I'm not a smoker but why is it that most smokers hold their cigarettes outside of the car window when they are smoking in the car? I know it's random but I have always wondered about this.

The City of Houston ordinance says 25 feet away from the door to light up a cancer stick. I have never heard of a comparable OSHA regulation.

I do know. During the evaluation of my trade in five years ago two different employees commented there was no cigarette smell whatsoever. The car had been smoked in for at least three to four years.

As a smoker I can say I personally hold my cigarette out the window because when the windows are closed the car gets smokey. Also, the interior glass stays cleaner longer when I do that.

I would just do the shop and not worry about where others are smoking. If you take yourself to seriously there can be unproductive results.

I think holding the cigarette outside the car is rude. If I wanted to breathe smoke I would be an effing smoker.
And then there are the people who toss 'em without bothering to extinguish them first. A home south of our town burned down last week after someone threw a cigarette butt out the window. It smouldered in some dry grass, the grass fire spread, and presto! House was on fire.
I have a gas station shop where the employees smoked next to the propane tanks. There was a sign that clearly said, "No smoking" on the tank rack. The question asked if the employees followed the smoking policy, i. e., 15 feet from the door, which is approximately the distance to where the tanks are located. Well, I reported that they were following policy, but they shouldn't be by the tanks. They don't smoke there anymore!
