Personal Injury and Mystery Shopping

Has anyone had to prove potential income from mystery shopping in a plaintiff side personal injury case?

I have my emails where I had to cancel shops because I was unable to complete them. I'm looking for way to list the potential income (jobs) I cold have made.

I printing off every email job notice I had to opportunity to take. Good thing I never got around to cleaning out my in-box. My attorney is also researching this subject, but thought I would consult the real experts here on the forum.

I also have my payment statements and emails from the last quarter. Glad I took all those BBA .

Don't you have a spreadsheet which lists all of your jobs for the past few years? While what happened in the past is no guarantee of what shops you might have gotten, it is a start. I guess you are trying to show all of the shops which were available to you to either accept or request? I think you should ask your attorney about using historical trends. You would also have your Schedule C from each tax year to document that this is indeed a profit making business.

I think if you can prove you averaged "X" amount in the prior quarter and had offers of "5X" in the period in which you couldn't work, you'd have a fair case that you could have made at least "X" had you not been unable to work.

But ... you're probably going to have to use your "in the pocket" figure, not gross fees. For that you should figure your vehicle expenses as "actual expenses" for gas and oil and not use the standard mileage deduction.

However, you are probably better off getting more in pain and suffering than trying to get much for lost income because the award allocated to lost income may be taxable and medical payments and pain and suffering generally are not.

Time to build a bigger bridge.
