Marketforce Facebook page

Market Force Information Facebook page now lists multiple of the company's clients. The clients' brand logos appear very clear. How can Market Force force its shoppers to sign an ICA in which they agree not to share their clients' names and the promote their company online with full loud advertising that explicity shows the company's clients?

I see that too on their FB page. I guess they can do what they want but we can't because of what we signed. That's life I guess, huh?
I guess I don't get your point. But to answer your question, "How can Market Force force its shoppers to sign an ICA," the short answer is that Market Force does not force anyone to sign an ICA with them. Market Force has an ICA available and those individuals who wish to work with Market Force make a decision whether or not they wish to sign it. There is no force. Each individual has a choice.

If an individual chooses to sign an ICA, regardless of what the company may or may not do in other areas, the ICA that an individual shopper has chosen to sign is binding.

If you don't want to sign MF's ICA, don't sign it. If you don't want to work with MF, don't work with them. As ICs, we run our own companies. We pick and choose who we work for and what assignments we accept.
To me it makes sense that a company would want to do their own advertising or promoting. I might not portray the relationship the way they want it portrayed.

Companies state who their clients are. That doesn't mean I'm free to join in.

What does sharing info from a fb page have to do
with promoting a company? No one says you have
to unless of course you have their advertising account.

My point is that none of the other MSC's are openly advertising their specific clients' names on their FB sites. But Marketforce IS. It's a sharp step away from what MSC's have done as a whole. I wonder how Marketforce clients would react to seeing their brands openly advertised on the company website?
The ICA is our contract with the MSC. Clients and MSC have an entirely different contract. In all likelihood whether or not the client's name can be used in advertising or on FB is outlined in their contract. It is becoming more common for MSCs to make client lists more public. Will this change the game in the future, maybe.

And please understand...I am not suggesting that I can break an ICA contract, I am just speculating this policy of open advertising for their clients that no other MSC has seem to have done before..that's all.

I used the word "force" as an intended pun to contrast the way shoppers are asked to sign an agreement they won't reveal the MSC's clients and yet the MSC is openly listing its clients on a social media site to which the world has access.

It's their call to make with these testimonials, but it sets a stupid example for shoppers who abide by their ICA..

You signed a contract not to share information from assignments. The difference between that and MF Facebooking is that MF is not announcing assignments via Facebook while naming the client. You do not share the same contract as the one MF has with its clients. And I guarantee that MF most likely got their butt covered by signing an agreement with clients stating that they may share their names in assignments or promotional ventures...

If it's really true that MF has 350 or so clients, apparently this business tactic is working well for them. Not every MSC will run their business that way
