scanman,
Having taken attorney advice, every MSC recording shops in FL treats it as a two party consent state. The issue is when a conversation "might reasonably be overheard." When you consider how many recorded shops include conversations in private offices, in cars during test drives or going to look at a lot or an apartment, in elevators with only 2 occupants, in model homes/apartments otherwise vacant, at the reception desk of a hotel, car rental site, or medical office, and anyplace where the parties expect discussion their health, or economic circumstances NOT to be overheard, you can see where the second party would reasonably expect the conversation to be private. As I understand it, you are not doing recorded assignments (correct me if I am wrong, of course) in 2 party states, so you may not have encountered the issues that MSCs that authorize recorded shops have to consider.
