I saw nothing in the instructions that said the cashier could not be included in the photo. An employee was often in my interior menu photo in the old JIB shops. Of course I tried to shoot when they had their heads turned around, but sometimes the store was so busy that I just had to point and shoot. I could always come up with a reason, if necessary, for taking a menu picture. I cannot think of a reason for taking a photo of the drive-thru window, unless it is to take a shot of the dining room hours which are usually posted at the window.@boridi wrote:

I took it when he walked away to get the food and talk to another employee... but apparently he was watching me. You can also take it at an angle when you're a few feet away from the window.
