I'm a reporter so I regularly request public documents. Because of mystery shoppers ... an employee at Universal Orlando ended up getting arrested for stealing money from the transaction! The shoppers, incidentally, were named in the police report.

That was just plain sloppy on the part of the client and the MSC. In many cases MSCs and clients have written agreements that say that if an MS shows evidence of fraud or theft, the client will then send in their own employees to do a verification and use that result as evidence if a criminal case is pursued. AND the MSer is assured, prior to the shop, in writing, that they will not appear in court or be mentioned as a witness. In many other cases, the perp is confronted with video or audio evidence from the MS visit and given an opportunity to resign. In yet others, where there is a union contract with an arbitration clause, the perp if confronted by the employer AND the union rep and informed that in the face of video and/or audio evidence, the union will not pursue arbitration if the employee is fired or disciplined. Employee may decide to just resign. The situation that you describe is incredibly rare, I am happy to say.

Lesson: when doing cash integrity shops, check the fine print !!

Edited to add: I know of two MSC/client agreements that very specifically state that if evidence of fraud or theft is revealed, the CLIENT will immediately take over the investigation, exclusively and pursue it without reference to the MS report. That may not be the exact legal wording, but the intent should be obvious. And, I know this because it was revealed, in writing, before any MSer was accepted onto the "team" for those shops.

At least the client and MSC had the grace to tell you so that you could make an informed derision. Remember, please, that I was describing "best practices." As we all have learned in this business, not all MSCs (or their clients) can be counted on to use best practices.

I do P.I. work in 3 States. This is commonplace for me. I usually have to notarize my raw notes and the reports. I have never had to return to testify, but I would.
