This law will require shopper's to have a minimum qualification of Bachelors degree or current Appraiser/ Private Investigator through Department of Licensing and Regulatory Affairs.

A State Senator informed me the legislation is proposed. There are several states which have enacted similar legislation. Many MSC's and their clients circumvent the law. By conducting BPO's and property assessments by an unlicensed individual. The Consumer Financial Protection Bureau are monitoring these lenders and their activities with MSC's.

Property assessments are a whole different animal from MS AND are required to be done by licensed and approved appraisers if the mortgage loan is to meet most lender standards. It is appraisals that are the focus of most such legislation. Only NV has a really restrictive MS requirement for the MSCs to have a NV PI license and to use only shoppers who have gotten a NV work permit to work for them.

BPOs, or Broker Property Opinions, are not done by MSers. They are performed under state regulations by licensed real estate agents and brokers. In some states additional training it required of agents and brokers who do BPOs, but not in most. BY LAW most states require that any BPO state, prominently, that it is NOT an appraisal and should not be relied upon as an appraisal.

Laws about property appraisals and BPOs are not addressing what MSers do. Have any of you ever seen an MS assignment that required a BPO to be prepared by someone other than a licensed real estate agent or broker? If MSCs were evading the Real Estate and Appraisal Laws, that is what they would be asking for, according to the OP.

MSCs are not lenders for home mortgages as far as I can determine. Therefore I do not see what the proposed legislation has to do with Mystery Shoppers. Lenders may be clients of MSCs but not for the purposes of having shoppers doing illegal appraisals or BPOs.

However, the law has been circumvented in Michigan, and the appropriate step is being pursued to prevent the breach.

Get your facts first Bernie57.... and get accurate sources if you want to further it. Proposed is far different than actual. Mystery shopping is far different than what you are inferring unless you have a reference to back that up.

What concerns me is whether or not your source understands what MSers do and do not do. As for source, I would want a link to the text of the proposed legislation. That would be an accurate source IMHO. One just never knows what "outsiders" may think is involved in Mystery Shopping. So, if the legislator(s) who proposed something on incorrect assumptions about MS, we, and also the MSPA and the IMSC, may want to provide clarifying information that would help the process.
