The issue here is, "It runs in the background." Legally in Florida you must have the consent of both parties to audio record a conversation. Background recording will not be just recording yourself. While it is perfectly fine to repeat what was just said to me onto a recording device, it needs to be me saying it, not the person who said it without their permission to be recorded.
