Intouch nightmare

Today I quit this organization. I knew as soon as intouch came into it a good thing would spoil. You see, I have cancer, and Nov 26 I was scheduled to get surgery with the hopes to correct the situation. Day surgery, but never the less surgery. It isn't happening. In fact the doctor can't rebook for at least 2 months. I made plans because these people usually paid like clockwork, so I was confident I could do what I had to. I am also on a limited income, and the monies I earn at the end of the month are that much more important. The 60.00 would just about pay for the motel room so I could stay down there and do what I had to do(over night). I even got an email from Curtis stating I would get payed in full today, unless of coarse there are 2 Nov. 23rds and I am missing the second one. Well anyway, I went to check my bank balance and guess what--no money! I called Nicole, and she didn't have any ...concern at all. In fact she hung up the phone, because she "didn't like my attitude-hey with something like this going on, who wouldn't have attitude? No money-no surgery- and another 2 months for the cancer to grow- Merry Xmas to me. They of coarse stated they would get me the next pay period, but thats too late for me, as the surgery was suppose to be 11/26. The sad part about it they don't care. The next 2 months could mean the difference between just day surgery and outright kemo, but again- it's not their problem. Friendly advise to anyone reading this and thinking that intouch and service intelligence is a good place to work-don't. They don't care- will pay you when they feel like it, and when you ask them to do their job and pay you on schedule you will be the villian, You will not be appreciated.

That said, your attitude is not doing you any favors. You get more flies with honey than vinegar, and all that.

I've done shops for this company, and they pay every other Friday. But I don't count on any of the companies to pay like clockwork. Sorry to hear and wish you the best.

It's people like you that proves there are still people in this world that are caring even when it is a stranger. We need more people like you. I wish I was in a position to help. A week or two make all the difference when it comes to surviving cancer.

This email does not say you would be paid today. This was an enquiry that was sent to the payroll department on Wednesday of this week. You will be paid on the next shopper pay which is December 7th for the 4 shops that were done on November 9th and 10th

I didn't have attitude when I first asked, and if any attitude is showing I think it is more than justified. When you do a job for someone for monies then payment is expected. They put me in a bad situation, and show no regrets that they did. Further they did not pay me as agreed. They claim to pay every 2 weeks, and my last assignment was turned in on or about the 10th, making the next paydate the 23rd. They delayed my medical treatment, and I want to make sure anyone who is crazy enough to even think of working for these"Wonderful human beings" thinks about that idea long and hard.
In your original post you called Nicole a b****, which I see you've now edited. If you used that language to us, who knows what sort of language you used with them.

Anyway, from those emails, it does look like they promised you payment on Nov 23. I would have a serious problem being told that I would be paid "on Nov 23" and then being told that that "does not say you would be paid today". What the heck? I would absolutely fight that.

You have a very legitimate complaint, IMO. I still stand by my "more flies with honey" comment though.

I started my conversations with them in a polite/professional mannor, after all they were my employer. As I stated, I quit, because I will not work for a company that will not pay me. Period. The attitude came toward Nicole when she talked over me, acted like she didn't hear what I was saying over the phone, denied the email stated I was suppose to be paid on the 23rd (you be the judge) and then finally slamed the phone in my ear.

I guess I am old school. I believe in an employer/ employee relationship where one person does a job and the other pays them for it. Everything is agreed to up front, and problems are presented to the other party, not sprung on them.

I got that email, after I called the company and asked for conformation that I was to be part of the payroll 11/23. I posted to this forum the answer I got. I then made arrangements for cancer surgery, based on what they told me. Them not paying me left me with no alternitive but to cancel the surgery, which basicaly bites as the doc is top notch and hard to get. I am on a limited income, and funds at the end of the month are just not there- so there was nothing to cover the loss.

I didn't ask for anything special- I asked for what was rightfully mine, and was denied. I asked for it to be delivered on a time frame they set up. As a result I have a cancer that is growing and a 2 month wait to get rid of it. Merry Xmas to me. AS for the flies with honey comment, I have no problem with that, in fact I agree with you, however the situation was severe, the satff uncaring to a loyal long term employee, and basically they have contributed to my health being at risk. I believe I have shown more restraint then anyone given the situation.

Oh, and there are 6/10.00 shops in question- If you note the second email I posted, they only plan on paying for 4, if that.+
Unfortunately, the relationship is not employer/employee. Have you looked back at your contract with them to see if payment terms are included? The ICA is a legal document and if your end of the contract was fulfilled within their specifications they are legally obligated to pay you under those terms.

Something else I don't understand, why wouldn't the doctor have worked with you on such a trifling amount?

I agree with Lisa. They are not your employer. However, what they have done is not cool. Doctors and hospitals are in the business of caring for people and I don't think they would have minded a wait of a couple of weeks for $60.00. I would have gone ahead and had the surgery anyway.
The amount-60.00 was to cover lodging while I was down there. Part of the deal for this day surgery was I was not to transport myself when I left the hospital. The 60 was to cover a motel where I could crash overnight.Taxi between the hospital and motel. I would have driven home the next day. It's not the doctors problem regarding what happens outside the hospital. He tells me how he wants things to happen and it's my job to see that it does.

Yes I delivered the secret shops in the mannor required. They have been paying every 2 weeks and promised to do so this time (see email). Again, I made arrangements based on the contents of that email. The day after Thanksgiving intouch and my bank were both open. The date of the last shop was the 10th...that makes the 23rd the next payday.

If there was a problem with transmitting- they should have said so, I can forgive that. Being rude, offering no explaination, and basically having the catch ya next time attitude is not working. As a result, I am paying for it, in more ways then one.

You are wrong that the MSCs are our employers. We are independent businesses and the difference is not that we pay all the taxes. Employers do not pay an employee's taxes. They do make other contributions to FICA, etc., but not income taxes.

Regardless of the past pay history, my question still stands. Are their payment terms outlined in the ICA which is a legal document? Not all MSCs include that in the contract. MSCs also change their payment terms and, whether we like it or not, whether it is "fair" or not, it can be within their rights. We are at a time of year when some of them actually shorten payment terms to allow their contractors to get payments in before Christmas. Others are going to be delayed because of long holiday weekends. Many of them also cover their own butts with statements such as, on or about. I read an ICA just today that said payment terms were subject to change without notice at the discretion of the MSC.

Alot of hospitals have special agreements with nearby hotels, especially for cancer patients. Try talking with a patient advocate, so they can help you.
The Patient Advocate is the way to go. I had problems with getting things scheduled last year when I got a diagnosis of lung cancer. I was having trouble with appts. getting scheduled in a timely manner, etc. At one point during a screw-up when the hospital did not do a test properly and were wanting to put me off to a later date which would push out a dr. appt. I literally lost it in the hallway. Cried, used a few four letter words, etc. My daughter who is an RN at that very hospital said let's go see the Patient Advocate. And, wow, what a difference that made. I, too, know about the honey/vinegar thingy but once you are diagnosed with cancer you feel tremendous pressure to get things done as quickly as possible.

I understand exactly how you feel about the time frame. I, too, felt pressured to do something right away, like now or yesterday.

I now know what the Patient Advocate can do and how powerful he/she is in the hospital administration. I also have a wonderful Patient Coordinator who handles/schedules all my appts., fields my questions and generally is an absolutely marvelous support person.

I lucked out and went into a case study where I had 5 days of high dose radiation vs. 6 wks. of low dose radiation. That happened last June. In Jan. of this year my dr. did a PET scan and he saw only the "carcass" of the cancer so basically we killed that sucker. ;-)

Lisa- A MSC hires people like me to do a job. In exchange, you give me money for performing said job. That by definition is an employer/employee relationship.

A regular employment arrangement would have a person getting items subtracted from their check (fica, medicare, etc) The employer matches those deductions and pays the appropiate people.

a 1099 employee pays all the taxes- state, local and Social Security, both what I would normally have taken out of a check and your portion. Instead of you paying the appropiate people, it falls to me to handle it.

Yes I did finally check- the manual, has a one line entry on the last page regarding paychecks. 2-4 weeks apart.

Now before you say ahha..

They promised payment for the 23rd.-in writing and on the phone, at the 2 week point.

If they were unable to deliver, why not tell me on the 23rd? For that matter why promise at all? I was in touch with them the Wednesday before and no mention of any difficulties transmitting were expressed. The flip attitude didn't exactly help the situation. It may be with in their right to hold onto payment (not fair) but when you have someone on the phone asking for their money, you don't mislead them. It gives the appearance you are a rippoff company. There needs to be trust between employer and employee or there might as well be no working relationship. If you say you will pay on the 23rd-then thats what you do, you don't tell the person you will, don't and then act like a fart when you get called on it.

AS for any arrangements-too little to late- Guys, it's the holiday season- the doc is long gone to be with his family. NO I didn't think to ask about special arrangements for cancer patients, it would not have mattered anyway- I didn't have the 60.00 and I know free isn't a word that would enter the conversation.
Shadow - After being a patient with cancer vs. other ailments, cancer patients get royal treatment in comparison to the average joe. I strongly urge you to contact your patient advocate and/or patient coordinator. My daughter is an RN and she's the one who told me what the pt advocate and pt coord. can do for me and how her dept. at the hospital responds to those folks. I know that you have a strong sense of urgency to get this taken care of NOW rather than later. It could be that the advocate or coord. can find you another dr. who can do the surgery for you.

I know you feel your fight is with the MSC but I think you need to change your priority and make your fight the cancer. Contact the pt. adv. and/or pt. coord., please!
Shadow, I owe you an apology. I should have tried to send you the $60 you needed when you first posted. I assumed it was already too late to make the appointment, but I realize now I could have been wrong. I'm hoping you get the surgery while the cancer is still manageable. Please let us know if you've been able to get another appointment and if you can manage your accommodations the night after the surgery.

Absolutely, many, many hospitals do.

I've also known people (not even the patients, but rather relatives and extended family/friends) to have even slept in their cars (in Boston), in the parking garages at many of the area hospitals.

The patiet advocate could have given you a voucher for the hotel and you would not have had to pay anything. All hospitals have assistance programs for cancer patients,you just have to ask. I live in Durham, which is the home to one of best cancer hospitals in the world, Duke, which i how I know about these programs. Please take advantage of your resources and contact a patient advocte. There was no reason for your surgery to be delayed over a hotel stay.
I thank all that are supportive. I say again, to the people who are offering to send 60 to me via paypal-I dont want your money. THis is my problem and I will deal with it. Lets redefine what is happening and why I started this thread.

I was looking for intouch to pay me what they owed me. They payed every 2 weeks like clockwork. I called them and got a verbal and an email stating monies were coming. Then nothing showed up. I am angry because this is the one time I actually needed the funds to arrive on time. I made rather serious plans based on what they told me. (F.Y.I. I don't believe the hospital would have allowed me to sleep in the car- it's 20 degress outside @ night- and the thought had occured to me.)

Anyway

This goes way beyond the cancer treatment. It also is now an issue of trust. I can't work for a company that I can't trust to deliver the payment. If there was any possible problem with the transmission of payroll, it should of would of could of been told to me while I was on the phone, or maybe the email should have stated it. Nothing. In short- they got theirs, on time they way they wanted- I got buttkiss. Oh, and I did explain to intouch why it was so important that I get the money- I was told not to worry. When they didnt deliver and I called them, I was made to feel like an insect at best.

AS for the cancer treatment- I am rescheduled for the end of January. Thank you intouch for distroying the plans. I am not mad at MSC as a whole just one company for one action. IF I cant trust you I can't work for you, bottom line
So the plumber you hire to snake the drain is your employee? I hope you are making all the appropriate deductions and paying the IRS.

I do not want to be an employee of a mystery shopping company since that would mean working the hours they set for me and losing the ability to choose which assignments suit me. I would also give up the option of negotiating for higher fees, mileage and expense reimbursement. As a business owner I choose what I want to do and when I want to do it. My skill determines what I make hourly, it is not set by the MSC.

I also sympathize with you and wish the best for you in your treatment. You will be in my
thoughts and prayers. Please do let us know how your treatment works out and that you
are okay.

As you requested, to get back to the reason you started the thread: payment not made
when expected. I don't really have a dog in this hunt because I have never worked for
InTouch. I agree it is upsetting to not be paid when you expect the money. But, having
worked with this company successfully for five years, apparently with no problems, it
appears that this is the first time they have disappointed you. One late payment in
five years doesn't sound unforgivable to me. Your medical treatment happenning at the
same time as their first late payment in five years is an unfortunate coincidence. The
payment issue is really separate from your treatment need. You didn't mention the
volume of work you have performed for them, but over 5 years I am sure there were
numerous paydates. Even a good company can have an "uh-oh" every now and again.
One late payment from a MSC with whom I had worked for five years would probably not
cause me to completely lose trust .... unless I did not get paid at all. I would be
inclined to continue to work with them based on five years history with them.
I still say contact the patient advocate. They coulfd help you get an earlier surgery or a different physician.
Lisa- you accuse me of attitude--- it sounds like you are the one with a problem. RE Plumber example: The plumber is there because I would have asked him to come. He is doing a service that I asked him to do. He is doing it on my schedule not his. I am giving him money when the work is finished. (unlike intouch, I am not telling him to "catch me next time"winking smiley. Yes he is an employee. He is a 1099 employee as I do not pay his taxes, he does. And according to the IRS, I believe 1099 pay full taxes when their income exceeds 400.00. Much like the secret shopper.

I have no clue what you are talking about "negotiate fees, as the job boards I have seen have a set price on them. Bonus always come at the end of the month when they get desperate for a job to be worked. As for mileage and any other reinbursements that is always spelled out when the job is offered.

Austin Mom- The anger comes from the fact that when presented with the reason for the paycheck need, I was promised a payment they had no intention of delivering on. Before it was intouch it was Service Intelligence, and Service Intelligence was awsome to work for. I believe the intouch group are former kern people, hence the problems with pay.
Not one comment I've made is snide and not once did I even mention your attitude or say that it was either bad or good. I was the one who suggested you look at the ICA and see if the payment terms are included. That would then make the e-mail moot because they would be violating the agreement which I assume is legally binding. So while I disagree with you regarding employee status, I actually offered a suggestion to assist you in dealing with the company.

Many of us do negotiate fees, bonuses, mileage, shop dates, report times and even expenses. And as independent contractors we are required to report and pay taxes on all our fees whether they are above $600 or not.

You do sounds angry. moody smiley It must not be doing your health any goodsad smiley sad smiley. It seems like you knew of the problems that IT/SI was having. It was just a matter of time. By the fact it happened to you at the same time you were anticipating surgery comes stressful to you. I am sorry

OK so don't work for IT/SI again. But is that hurting you or them? For five years they were like clockwork to you. Now you will have to get use to something else.

If I sound harst, I am not trying to be. But right now you are upset. You are "yelling" at the (forum) repliers and the MSC for something that may have not be forseen either by the MSC or the Doctor. And like I said you can't be doing your health anygood.

I, too, work in a hospital. Talk with the advocate. Get your health back on the road to recovery, then worry about the MSC. Now that you have rescheduled the surgery, get questions and situations answered before they show up again. Good luck but calm down.
I am very sorry for the OP's entire situation ~ it would be a nightmare any time, but especially around the holidays. And, I know if I'd just gotten that diagnosis, I'd be more than a little prone to freaking out over any/everything, too ~ especially at the MSC who ruined everything that had been set up, by their non (or late) payment. Including a few four-letter words, more than likely.

Please do contact a patient advocate... I heartily concur with everything said about them by the others.

I don't know how else to possibly try to explain it, but (thank God!) we are NOT employees of the MSC's. Not employees in any way, shape, or form. We are independent contractors, which is an *entirely* different thing. Any legal or governmental entity would NOT support nor recognize us as employees. It's like we're each running our own small business ~ consisting of us! If we were employees, as Lisa said, we'd have to report for work at certain hours and take each and every job they send our way regardless of pay. Plus a ton of other little things that differentiate IC's vs. employees. And, of course, if we were employees, we wouldn't get paid by the job/assignment. Just Google "employee vs independent contractor" for more intricate explanations.

And yes, you can negotiate all kind of things with the MSC! Which I hadn't thought of, either, though, until reading about how to do it on this forum.
