I haven't reviewed the Del Taco shop specs, but I agree, why not just offer a reimbursement amount that covers the upsell and ask if you were upsold or not. I have done shops for another company with another fast food place, and if you were just offered to upgrade from a small to large, you didn't have to take the upsell, but you got to reward the employee for a successful offer with a $5 amz gift card and a little certificate. I enjoyed those, the employees did too.
I personally didn't take the upsell - they offered you a large beverage instead of a small, and I don't really drink pop/soda or sugary drinks, so I don't need a gigantic 44 oz beverage, I'm fine with 20 oz.

It's a flawed approach from the beginning. They should just ask you if you were upsold or if you had to request the combo meal yourself. I guess a shady shopper could lie there too if they didn't like the employee who served them, but I think the probability of lying would happen more in the case where the employee did not upsell
This is true. It is a poor practice. There is an MSC with a new client in my area where they are doing this very thing. It also doesn't make sense to me. Why would they only want the dessert evaluated if you are asked about it?
