Franchise Compliance - A Modest Proposal . . .

Better hurry while they still have an operating address. Did I read rigt that someone here is owed for an entire cruise?

Nobody is owed for a cruise. FC does not offer them. Julie was making a reference to a posting by another MSC she has absolutely no affiliation with.

I agree with Iguana. I think that everyone who hasn't been paid should collectively send a complaint letter or email to the Utah BBB and the Utah Attorney General's office.
I just filed a complaint with the FTC. I reccomend the rest of you awaiting payment do the same.
Was just on the main Sassie site and they still are recommending
Franchise Compliance on their list of companies to contact.

Vince writes well about violation of contract law.

Maybe he should write Sassie a strong letter about taking Franchise Conpliance
off their list of recommended MSC's.

can you offer a link to the sassie page that recommends franchise compliance? or does the reference just mean that franchise compliance uses the sassie program?

Vince

it wasnt SASSIE it was MSPA and

MSPA phone number is: 1-502-574-9033.

Wonderful idea to give out their phone number. Ask why they still have the carpet cleaning company FRANCHISE COMPLIANCE (see Flash's thread by the same name) listed on MSPA when there are a zillion complaints about never being paid.

If they do nothing to take it off, file a complaint with the BBB. and tell them you are going to.
MSPA might not want to lose their A+ status
It's been well established that BBB handles consumer complaints and won't listen to shopper requests for deadbeat MSCs, since they are business to business transactions.

However, we are customers of the MSPA is we purchased a certification. I wonder if the BBB would field a complaint about the MSPA representing fraudulent companies?
About a year ago I filed a BBB complaint against a MSC for not paying me. I was paid within days. I was deactivated but I had lost confidence in the company anyways.
Today I filed an complaint against Franchise Compliance with the Utah BBB. I encourage everyone who is waiting for payment to do the same. My hope is that there will be strength in numbers and the BBB will take action if they receive a large amount of complaints in a short period of time.
Here is what the Utah BBB says about Franchise Compliance's complaints:

"Customer Complaints Summary
12 complaints closed with BBB in last 3 years | 6 closed in last 12 months
Complaint Type Total Closed Complaints
Billing / Collection Issues 3
Problems with Product / Service 9
Advertising / Sales Issues 0
Delivery Issues 0
Guarantee / Warranty Issues 0
Total Closed Complaints 12

Additional Complaint Information
The BBB has received numerous complaints from consumers who allege that they did mystery shopping work for this company and were not paid for the shopping they did (most customers had carpet cleaning performed) or the shopping itself. "
I have been emailing Julie Bishop as well since December 2011 for the shop I completed at that time. I waited the appropriate time and like everyone else, I never received payment. I was told that they missed the payment and it would be in the next cycle in April. Again, I received nothing. Obnoxiously, there was even the additional expense of a special mailing requirement that I had to purchase from the post office and Julie assured me I would be reimbursed for that as well. I was just about to send ANOTHER email inquiry about my payment and "scam" came to my brain and I found this blog. I see I am not alone in all of this. Misery enjoys company, but what to do about payment???
Sorry, myown, I don't think you will be getting any payment or reimbursement from this company from the sound of it, no matter how hard you try. Or so it seems.

Hi myown. Welcome to the "Franchise Compliance Owes Me Money Club". The club that nobody wants to be a member of, including me!
Sadly, these are relatively expensive shops.

It goes without saying that no shopper should take a shop for this company at this point. Not just for their own financial safety, but to support other shoppers left holding the bag as well.

I wish there was something more proactive that could be done, however. There are so many shoppers out there who are not on forums that this could continue for quite some time.

Perhaps a letter writing or phone call campaign from ALL shoppers on all forums to FC, Harris Research and Surfmerchants would help....

While Surfmerchants is not directly responsible, allowing FC to continue using Sassie if they know it's being used for fraud would definitely bring them into question as being partly responsible in a lawsuit.

Steve,

Could you please describe the relationship with Harris Research and Surfmerchants or direct me to the portion of the thread that addressed this? Guess I have not been following closely enough.

Thank you so!

Harris Research is the parent company of the client that the shops were performed for.

Surfmerchhants is the company that owns and operates Sassie. They sell the software and webspace to MSCs.
I have been in touch with representatives from Harris Research who vehemently deny any association with Chem Dry or Franchise Compliance. However, if you Google Harris Research, you will be directed to a Chem Dry website which states:

".........Harris Research owns two brands Chem-Dry Carpet, Tile and Upholstery Cleaning and N-Hance Revolutionary Wood Renewal."

The way I see it is that Chem Dry, owned by Harris Research, is contracting with Franchise Compliance so, I think, Harris Research has some responsibility to shoppers. At the very least, HR need to stop denying their relationship to Chem Dry.
Perhaps it is also time to start naming schedulers still trying to find shoppers for Franchise Compliance jobs. I think one must wonder about the integrity of any scheduler who is still attempting to schedule for them. In the recent past I have had:

rsilvestri@franchisecompliance.com as the party sending the email, though it was 'signed' Julie with jbishop@franchisecompliance.com as her signature address.

rsilvestri@franchisecompliance.com signing as Ralph, so I have to assume the name is Ralph Silvestri
On March 29, I received an email from Kami at kolsen@franchisecompliance.com looking for shoppers for these locations:

carpet cleaning solicitation received 3/18/2012 from
molsen@franchisecompliance.com who signs
Maddi
Franchise Compliance, Inc.

in 2011 received from wnoorda@franchisecompliance.com
who signs
Whitney
Franchise Compliance

I've also received some from kolsen

I think I've deleted all the others immediately....no way.......
I had no idea Kami was still working for FC. Sad, because she was very nice to deal with back when they were a good company to work for.

If you check Sassie there are currently 173 open shops. 140 for the carpet cleaning company!

Even if you average those out at $100 per shop, it's over $17,000 owed just for a month, and that's not considering what may have already been scheduled this month.

I think that this may start looking appetizing to a class action attorney at some point. If one could subpoena the records from Surfmerchant and contact all FC shoppers, it could be a decent sized lawsuit.....
Well, perhaps I can compile a single post with all contact info and update it as more info comes in.

It would be nice if all shoppers, even the ones who are not owed money, could send a note to FC and let them know they are not accepting any jobs for FC until this matter has been resolved.

Here's what I have gleaned from various posts:

I may be mistaken but, I don't think a subpoena is necessary. Information is available to the public under the Freedom of Information Act.
You may be mistaken. I believe that covers government held information. The email addresses are held by a private firm.
Freedom of Information Act refers to information held by the US Government. Many states have 'Sunshine Laws' that refer to state and local documents and meetings of public officials. The Franchise Compliance information would not fall into any of those categories so would need to be obtained by court ordered subpoena.
Ok, yes, you're right about that. It does only pertain to government documents.
I have never worked for Franchise Compliance...never willl. However, I saw another shopper on here talking about a different MSC and his collection efforts. He created a Paypal invoice to the email address of I believe his scheduler. When the invoice was not paid, he threatened turning the unpaid invoice over to a collection company.

Do you think this could work for you? IDK, just a thought to help a shopper out. smiling smiley
