A quick update
This is being posted after being reviewed and approved by my attorney.

There have been several exchanges between the attorneys and we have sent to the MSC a printout of the topic posted on the website, the police report and the hospital records.
The MSC is now taking the position that they DID NOT personally read what was posted and were relying on what the scheduler was telling them.
The MSC is admitting that the scheduler was lying to them about was posted to get at me for not completing the shop.
(talk about a negligent CEO for not personally verifying)!

This does not at all justify the extent of the threats made by the CEO to me.
They have been sent a copy of the lawsiuit that will be filed.
They have offered a low 6 digit settlement so far.
I am seeking a high six digit settlement and an agreement to post publicly who the scheduler is and the MSPA to be notified of the schedulers actions.
The MSC wants to handle the scheduler in house. ( scheduler is till working).
If they do not come up on the settlement within the next 10 days the lawsuit will be filed.

I hope that you are feeling ok, physically now.

We will watch for an update once you file or don't file depending on what you and your attorney decide.

I hope he got a boat load of money, and isn't answering because there was a gag order in the settlement.

Shopper in California's Bay Area
In a number of years of shopping, I have yet to run into a scheduler who wasn't reasonable, not only on rescheduling, but on weather induced cancellations and emergencies. I love my schedulers, and they've taken very good care of me. Of course, I develop close relationships with them, which also results on getting some premium jobs (actually, a lot of premium jobs). I think the friendliness and responsiveness of schedulers is directly related to how reliable the shopper is as a matter of course. Even in some bizarre cases, and we had one recently where in one week, my car was sideswiped in a hit and run, and major gale force thunderstorms wiped out our road, essentially sticking it to us for a week, the schedulers from multiple companies not only reworked everything I asked for and cancelled without penalty those which I couldn't, but two of them even rescheduled with an added bonus t help out the lost time situation. I'm a Silver and IC-Pro Shopper with about 3900 shops.
If I received a flake citation for such an occurence, I would report the scheduler to the MSC. Shopper's histories are recorded and it would make sense that a schedulers inappropriate actions would be also by the MSC.
