Who is "she" You mean Katy? Has she responded? A class lawsuit would be a whole different thing. You would need a lawyer for that. It would be expansive, as they charge by the hour. I am not sure that the $$ amount of this claim would even add up to what a class action would take....

No response from her yet, we're working on the legal paperwork right now and having her local sheriff department serve her.

Class action lawsuit,I am owed close to a thousand dollars and I'm sure others here are also owed more or less the same.
If you are working with the sheriff, I would think that your chances are pretty good! Good for you! All of you! smiling smiley
Nobody has been able to find this MSC as a registered business. So if the owner tried to get any kind of business loans or grants for covid she might not be able to get them.

I've checked everywhere and there is no sign of SCS registered with California as a business entity, I guess she's a sole propietorship.

As a sole proprietorship, perhaps she uses a DBA. I think that DBAs may be filed at the county level, but do not know enough to state that for certain. When I googled DBA, the article mentioned that the sole owner may register with their own legal name.
Interesting. And it expired in 2017. From what I have read here is that between 2017 and now she had "family problems" that caused her to be late on shopper payments for a time. The problems may have also caused her to let her license expire and move to a new address. Just an idea. I do not know her personally at all.
I googled "running dba on expired license." Some of the Q & A was interesting. A DBA must be renewed periodically; I think that it specifically mentioned that it was a five-year duration in California.

If she is running a business on an expired license, is that not illegal?

I have no skin in this game. I just cannot stand when unscrupulous people try to cheat others.
I've located three addresses affiliated with her from public records, legal papers will be served on those addresses soon. She can run from our emails but I wish her luck running when the sheriff shows up. Run Katy Run!

All of you who can - it's only $35 to file a small claims case against her and the process is fully electronic (submit PDFs, pay with credit card) to Placer County Small Claims Court.

Wow! That sounds easy! I don't think it is electronic in some places so this will be very convenient. How did you figure out which address of hers to file the small claim for?

If you go here and use the eDelivery to send the documents in, you need to fill out SC-100 form and then submit it to them via eDelivery, pay the $34 fee online via credit card.

I did a lot of digging and decided to serve three of her addresses which I thought had the best chance of reaching her, everyone who is owed money please file small claims suit against her and her business.

If you let her get away with this, shame on you - she owes us hundreds if not a thousand or more each and based on the amount of posts I've seen she probably owes thousands if not tens of thousands to her independent contractors!
I’m sure that’s true, about her owing a lot of ICs. You guys are lucky to have each other on this blog! The electronic way to serve is very cool - it makes it much easier for you to pursue the claims.

if she owes you anything, go after her Jazzgirl. Don't let her think she can get away with our hard earned money.
Didn't she send somebody an email saying that she was going to take care of her family first? Hence, she used the shoppers' money to pay her bills, and the shoppers paid for things such as parking and meals on their own dime. Good luck at getting anything. She looks like trash to me.

No - she does not owe me - I just got involved here because I wanted to relate what happened to me years ago, and how I resolved it. My $$$ were $1500, and I did get it all back!

If she doesn’t have the cash now her future earnings can be attached. There are a lot of ways that she will only make her situation worse if she does not find a way to pay and move on....like destroying her credit report, her business opportunities, lein on property, etc.

I would bet that she has been collecting the IC stimulus each week - that is a lot of cash. If she gets in trouble with the law, the stimulus could be cut off, or they would expect her to pay it back. AKA more problems!

My apologies for the delayed communication to those who may have reached out to me. As you may be aware, California is one of the states that was declared a state of emergency with strict restrictions in place. This has impacted many businesses, including my own, bringing work duties to a rapid halt and causing significant financial hardships, as well as major life style changes.

Due to Covid-19, all my clients have suspended shops. The outcome of this has also seemingly affected my clients’ Accounts Payable procedures. Due to these business closures, it has been challenging to resolve the financial delays with my clients’, but I am diligently working on it, as well as, looking into the recent small business relief options available.

I want to be transparent with you all; these are unprecedented times and there may be a long road ahead of us. With everything going on, there is a chance that I may not get the much-needed resolution with my clients or other small business options until the business sector commences once again.

Depending on how long this situation lasts, many businesses, especially restaurants, face uncertainty on what their future holds. As you can imagine, when running a business, if all your stores are shut down or business hours are significantly reduced, this ultimately impacts revenue causing temporary budget freezing. This has impacted my business, as I too have not received payment which is the revenue I need to pay shopper payments and reimbursements, as well as my own financial responsibilities as SCS is my main source of income.

There is always a level of uncertainty when dealing with an evolving situation, but there is a great deal of comfort in knowing that I have good relationships with my clients and trust that when their business resumes, the invoices will be paid allowing me to send out shopper payments and reimbursements, starting with any unpaid January shops.

I truly regret having to give you this information, however, the severity of this situation is significant, and I wanted to ensure you were up-to-date with the latest information that I have regarding these efforts. My promise to you is that I will work diligently to collect the funds needed so that I am able to send shopper payments and reimbursements. In addition, as soon as I find new/alternative temporary or permanent income for myself and my family, I will do my best to start paying shopper fees and reimbursements out of my own pocket as I can.

If you have any questions about this, please email me. As a reminder, everything in regard to the shops you do for my company is between you as an Independent Contractor and SCS. Within the agreement you signed with my company, all matters regarding the SCS shops, should be directed to SCS and not ever with any of the clients. We are pursuing this by the correct legal means in small claims court, if judgment is entered and she loses the case, she will legally have to pay me and whoever else sues her and wins their case. If she can not pay, there are other means to collecting the money including

1) Asking the court to assess all of her assets and property
2) Seizing from her personal bank accounts or safe deposit boxes with the help of the sheriff
3) Seizing from her business bank accounts with the help of the sheriff (that is if she didn't co mingle funds)
4) Having liens placed against her real property (house , land, etc) personal property (sheriff will seize her personal property and sell it at public auction) or lien on her accounts which will go on her credit history and ruin her financially for life.
5) Having her business license for SCS revoked if she even has one.
6) Hire a professional debt collection agency to go after her with their phone calls, letters, etc until she pays and trust me - they work.
7) wage garnishment - the court will withhold pay for her jobs

Yes we will make sure that even if she doesn't have enough cash right now, her future wages will be subject to court wage garnishment and withholding - liens will be placed against her property, her credit report will be trashed as a result etc etc.

She was given a fair chance to pay us all back in a timely manner but decided to ignore her window of opportunity.
I wonder if she has an ID for this forum and is reading this about her....what is she thinking after reading this.
