If there was a trust in place, there are procedures spelled out and all i's have to be dotted and all t's have to be crossed. If the estate goes into probate, it's even more complicated and could take years.

In either case, the trustee, executor, or administrator is required to 1. Notify all known or potential creditors in writing and 2. Publish a "notice to creditors" in a legal newspaper of the county in which the decedent resided.

EDITED TO ADD...I would try sending a letter via certified mail directly to the NSS office address listed on their website. Include all shop information (shop number, date shop was performed, amount due to you, etc, etc). If you have a copy of something showing the approval of the report for payment, include that also.

I would assume that all mail going to that location is being forwarded and that would at least provide proof of your claim as a creditor.

Even the probate courts in the least populated counties in CA have at least a 3 month backlog for probate filings. (I'm in the process of finalizing and closing the estate of my ex-husband and for what would be considered an extremely "uncomplicated" probate, it has taken 2 years)

Just did a print screen from the NSS website with all the documentation needed to support my two payments due. Easy to do and I plan to recommend that to my son also. Will take Inside's suggestion to send via cert. mail.

Screen shot everything you can find that identifies you as a contractor....your profile, shopper #, ICA, etc.

PS-I believe that probate filings are public record in CA. If anyone has an atty friend, have them do some digging.

If you look at the previous months when you have been paid, it will show a date the check was mailed. Not sure what you mean about it showing the check was cut.
I have the same situation as JASFLALMT. My account shows a Check ID number for my March shop that I completed. However, I never received any payment via check or paypal.

The only person that will have any power to do anything is the person the probate court assigns to administer the estate.

The harassment and confrontation you suggest will not solve anything.

It's obvious that the estate and the assignation of an administer/executor is now in the hands of the court. Letters of Administration may or may not have been already issued to that person.

Finding out who that person is should be the first order of business.
The rulings of the probate court and CA law are the only rules and laws that will apply moving forward.

anng123-I understand that you and others are upset because of a potential loss of income. But please take a step back and realize that you are also going to be dealing with a person who is still grieving and has recently lost a loved one. They are completely overwhelmed and doing the best they can.

You, on the other hand, can write off the loss on your taxes.

Complying with the legal system's processes is the best and only way to proceed.

They pay slowly but regularly. I have never had a problem getting paid by this company, but I do find I have to wait a long time for the payment.

Requesting records is reasonable, but they probably haven't been filed yet. Harassing, stalking, and confronting former employees is a good way to wind up in jail. Aren't you on a student visa? Surely you can figure out a better way to spend your summer than inciting people to commit felonies.

Okay, this is what I just did... I sadly found out I am owed more than I thought. It is $144 that they owe me. It took time to go back and look in paypal. Okay, so I printed out all the assignments and their information, I printed my entire profile which shows my shopper number and email/other identifying information. I have ALL their emails where they ask me to do assignments and the bonuses agreed. (guess it pays to keep some emails) I printed off everything they had on all the pages. I highly recommend everyone go in there and make a folder so hopefully some day, we can be paid back.

Doesn't the judge/trustee ask the estate manager what kind of business that NSS was and then they say NSS was a mystery shopping company. That is when "hopefully" the judge asks the estate if they OWE shoppers money?! smiling smiley
I'm assuming that the Daniel Wosniak mentioned on the court site is a brother or son. They would surely know the nature of Matt's businesses. In addition, all assets must be disclosed to the court. That's why it's important to find out who the executor and who the attorney (if any) representing the estate is so the proper claim procedure can be followed.

I had to email the probate attorney for my ex's estate today anyway, so I asked how to find out who the executor of an estate that's in probate is. With luck, she'll do a quick search and email me the info.

Since it's all a matter of public record, once the petition hearing takes place, that info may be available online using the case number. I know that every doc that was submitted to the court regarding my ex's estate can be accessed online that way.

As I stated before, you may be able to get the info from the Placer County Court Clerk's office.

The Trustee, Administrator, or Executor (all the same thing, just called different things) is the person that manages everything...but usually within the guidance of a probate attorney of their choosing.

The probate judge usually won't "ask" anything. It's pretty much a rubber stamp process as long as what's submitted to them looks feasible and follows the probate laws.

I would go ahead and mail copies of your claim documentation to the NSS offices to start off with. I'm pretty sure all that mail is being forwarded.

Then, as more info is obtained, a legal creditor claim can be properly filed directly with the court and the estate's executor.

I am filling out the form and it says "Do not include debts incurred after the date of death" Well...he died in February but his business had me doing assignments in March, April and May. What to do now?
I hope a nice employee in Placer County can help me over the phone to fill this out because some of this information I don't have or understand! tongue sticking out smiley

My guess is that whoever was in running NSS after his death is responsible for payments for shops performed after his death. Could get very sticky finding out that info.

I think the problem with this route is you're addressing it as if it were a personal liability and it is not. NSS is a separate legal and financial entity and your claims are with that entity. That the primary (even probably only) stockholder is deceased is completely irrelevant to NSS and any claim against them.

I did not see NSS on the MSPA list of member companies, but on the NSS website, NSS says it is a MSPA member. It might be worth contacting MSPA. Has anyone done that?

Interesting information. On the NSS main page, Under "About Us," NSS has always had 3 sections: Our Story, Our Community, and Meet Our Team. The "Meet Our Team" page has been removed.
